The San Francisco 49ers' star pass-rusher was arrested at Los Angeles International Airport on April 13 for making a fake bomb threat. He was later released on a $20,000 bond. The 49ers declined to comment on Thursday's development because the case is still pending.
Smith has a court appearance Tuesday on felony gun charges and a drunken driving charge in Santa Clara, Calif., County.
Smith, 24, also faces potential NFL discipline.
The 49ers must decide if they will give Smith a $9.75 million option or the 2015 season by May 3. A league source told ESPN NFL Insider Adam Schefter that the 49ers aren't expected to exercise that option.
